This agreement applies as between you, the User of this Website and All Out Cricket Ltd, the owner(s) of this Website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:

3.1 The Intellectual Property Rights subsisting in Comments belong to the Users who posted those Comments unless it is expressly stated otherwise.
3.2 Where expressly indicated, certain Content and the Intellectual Property Rights subsisting therein belongs to other parties.
3.3 The Content described in this Clause 3, unless expressly stated to be so, is not covered by any permission granted by Clause 2 of these Terms and Conditions to use Content from the Website. The exceptions in Clause 4 continue to apply.
4. Fair Use of Intellectual Property

7. Posting Comments
7.1 When posting a Comment on an Article you should do so in accordance with the following rules:

7.3 AOC may edit your Comment to comply with the provisions of sub-Clause 7.1 without prior consultation. In cases of severe breaches of the provisions of sub-Clause 7.1, your Comment may be removed and your Account may be suspended or terminated. You will not be informed in writing of the reasons for any such alterations or removals.
7.4 In order to post a Comment, you are required to submit certain personal details. By continuing to use this Website you represent and warrant that:
7.4.1 any information you submit is accurate and truthful; and
7.4.2 you will keep this information accurate and up-to-date.

7.8 You acknowledge that AOC may retain copies of any and all communications, information, Content and Comments sent to us or submitted to the Website.
8.1 The competitions that we run through the Services are subject to the following rules (unless otherwise specified):
8.1.1 No purchase is necessary.
8.1.2 One entry is permitted per household, and no bulk or third party entries are permitted.
8.1.3 Competitions are open to all UK residents (over the age of 18 in alcohol, tobacco or travel-related competitions, and in other cases as stated) except our employees, the companies or organisations with whom the competition or offer is being run, their agents, or anyone directly connected with the promotion.
8.1.4 Proof of entry will not be accepted as proof of receipt of entry.
8.1.5 If we run a competition or offer with a promoter where that promoter is responsible for the provision of the offer or prizes then AOC will not be responsible for or have any liability for the provision of those offers or prizes.
8.1.6 We reserve in all cases the right to replace the stated prizes with other prizes that we consider to be of broadly equivalent value. We offer no cash alternative for non-cash prizes, and prize winners must accept prizes in the form offered. Prizes are not refundable or transferable.
8.1.7 The winner may be required to sign a statement proving their eligibility/liability.
8.1.8 The closing date for receipt of entries is as stated for each individual competition. The winner(s) will be drawn at random from all valid entries, and will be notified by email within two weeks of the closing date.
8.1.9 Detail of the winner(s) can be obtained by sending a SAE marked [name of competition] to All Out Cricket Ltd, Unit 3.40 Canterbury Court, 1-3 Brixton Road, London, SW9 6DE, United Kingdom within 21 days of the closing date of the promotion.
8.1.10 All entrants to competitions and offers are deemed to have accepted these rules and agree to be bound by them, and agree to co-operate in any publicity that may arise which may include their name or image being used on websites, magazines or mobile services at any time as a result of the competition.
8.1.11 Some cricket equipment given away in competitions may have been used for testing purposes.
9.1 Certain pages on this Website display third party advertising. AOC has neither control over, nor involvement in, any third party advertising or the products and/or services featured therein.
9.2 Unless it is expressly stated (for reasons including, but not limited to, sponsorship), no advertising shall be taken as an endorsement by AOC of the products, services or any party associated therewith featured in advertising.

13. Limitation of Liability
13.1 To the maximum extent permitted by law, AOC accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. 13.2 Nothing in these terms and conditions excludes or restricts AOC’s liability for death or personal injury resulting from any negligence or fraud on the part of AOC.
13.3 Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
14. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
15. Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
16. Third Party Rights
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and AOC.
17.1 All notices / communications shall be given to us either by post to our Premises (see address above) or by email to firstname.lastname@example.org. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
17.2 AOC may from time to time send you information about our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from us.
18. Law and Jurisdiction
These terms and conditions and the relationship between you and AOC shall be governed by and construed in accordance with the Law of England and Wales and AOC and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
